Is this a scam?

No, this is not a scam. On Top of the World Communities, Inc., in partnership with Hospice of Marion County, is legitimately running a fundraiser. All raffle entry proceeds benefit Hospice of Marion County. Click here for full rules.

OTOW is an age-restricted community. Can entrants win if not 55?

The only age requirement for the contest is that you must be over 18 years of age. The Housing and Urban Development’s Fair Housing Act’s ‘Housing for Older Person’s Exemption’ of 1995 states that “in any age-restricted community at least 80 percent of the units must have at least one occupant who is 55 years of age or older.” Therefore, in accordance with the Housing for Older Person’s Exemption, should the winner of the HomeFreePrize raffle be under the age of 55, they may reside in the community as part of the 20 percent that is allowed to be under the age of 55. At no time can anyone under the age of 17 reside in the Indigo East community, even if there is someone over the age of 55 in the residence.

Does the winner have to pay taxes on the house?

Yes, the winner is responsible for all applicable taxes and fees.

How many entries can be purchased be an individual?

There is no limit to the number of tickets one person can purchase.

How many entries will be sold?

A maximum number of 35,000 entries will be sold.

Do you have to be present to win?

No, winner does not need to be present to win. If not present, winner will be contacted by telephone and email address provided on the HomeFreePrize entry.

How is the winning entrant determined?

Hospice of Marion County HomeFreePrize Raffle Official Rules and Conditions

Hospice of Marion County (“Hospice”) is a not for profit, 501(c)(3) charitable organization and conducting this raffle, or game of chance, pursuant to Florida Statutes, Section 849.0935. This raffle is a fundraising activity to benefit the charitable mission of Hospice.
These Official Rules and Conditions govern the conduct of the Homefree Prize Raffle and are binding on everyone who purchases or requests a raffle entry or is named on a raffle entry.
The Homefree Prize
The Homefree Prize is a newly constructed house, located in On Top of the World Communities in Ocala Florida, specifically the Ginger Model, which has a value of approximately $220,000. The Homefree Prize has been donated by On Top of the World Communities and its various subcontractors and vendors. Please visit the Homefree Prize website at HomeFreePrize.com to see a complete list of raffle sponsors.
Hospice may offer additional early incentive raffle prizes to encourage purchases of Homefree Prize entries. All raffle prizes which may be offered will be donated to Hospice. No portion of the Homefree Prize entry proceeds will be used to purchase raffle prizes.
The Homefree Prize Drawing
The Homefree Prize Drawing will take place on November 2, 2017 at approximately 6pm at Circle Square Cultural Center in Circle Square Commons, 8395 SW 80th St., Ocala, Fl 34481
The winner does not need to be present to win.  The drawing will be random and supervised by an independent auditor.
Purchasing a HomeFreePrize Entry
Homefree Prize entries may be purchased for a suggested minimum donation of $100. A maximum of 35,000 raffle entries will be sold. Raffle entries can be purchased online at HomeFreePrize.com or by phone by calling (352) 291-5143. Additionally, raffle entries will be available for sale at various locations in Ocala. Raffle entries may be paid for by cash, check or credit card. Paid raffle entries must be purchased or received by October 31, 2017 at 11:59 p.m. Any returned or canceled checks will disqualify the raffle entry. No refunds are available. Hospice assumes no responsibility for lost, misdirected, or otherwise failed to deliver raffle entries prior to any deadline. Purchases of raffle entries are not tax deductible contributions.
No purchase or contribution is necessary to participate in the Homefree Prize Raffle. There is a limit of one free or reduced contribution raffle entry per household. To receive a free raffle entry or purchase a raffle entry for less than the suggested minimum donation, please send your name, address, and phone number on an index card with a note indicating your request for a free or reduced payment raffle entry, and a self-addressed stamped envelope to Hospice of Marion County, ATTN: HomeFreePrize, PO Box 2796 Ocala, FL34478. Postmark may not be later than thirty (30) days prior to the date of the drawing.
Notification of Winner
If not present at the drawing, Hospice will notify the Homefree Prize winner by telephone and email provided on the Homefree Prize entry. If no reply to such notice is received within 24 hours, notice will be sent by certified mail with return receipt. Additionally, the Homefree Prize winner will be published on the Homefree Prize website after the drawing. If the winner does not claim the Homefree Prize within fifteen (15) days of notification, the winner will be deemed to have forfeited the Homefree Prize and another winner will be selected at a subsequent random drawing at a time and place determined by Hospice. If the winner declines to accept the Homefree Prize, another winner will be selected at a subsequent random drawing at a time and place determined by Hospice.
Participants must be 18 years of age or older and a legal United States resident. The executive leadership of Hospice and On Top of the World Communities, the Boards of Directors (Governance and Philanthropic) of Hospice, and staff of the Hospice Philanthropy Department and their immediate families are excluded from participating in the raffle. Any offer to participate is void where prohibited or restricted by law. Only one eligible person may be entered in the raffle per raffle entry. If the name of more than one person is submitted with a raffle entry, and that entry is selected as the winner, then the person named first will be deemed the Homefree Prize winner. The Homefree Prize winner may be required to execute an affidavit of eligibility and provide proof of identity.
General Rules
Homefree Prize entries are not transferable or assignable.
All entries must contain a name, mailing address, email address, and phone number to be valid.
The Homefree Prize winner will be responsible for all fees, local, state, and federal taxes, including but not limited to federal income taxes based on the value of the HomeFreePrize, which must be paid when the house is transferred to the HomeFreePrize winner. Hospice takes no responsibility for any tax liabilities. The Homefree Prize winner assumes all costs of home ownership, including but not limited to closing costs, attorneys’ fees, home owner association fees, transfer taxes, title policy fees, and real estate taxes.
The Homefree Prize will be transferred to the winner by On Top of the World Communities with its standard one year builder warranty provided to all new home purchasers. Hospice does not provide any guarantee or warranty, expressed or implied, in connection with the Homefree Prize and accepts no liability or responsibility regarding the construction or condition of the Homefree Prize.
The Homefree Prize will be transferred to the Homefree Prize winner through a closing transaction within thirty (30) days of the drawing, unless an extension of the closing is requested by the Homefree Prize winner. If the Homefree Prize winner fails to close on the House within ninety (90) days of the drawing, the winner will be deemed to have forfeited the Homefree Prize, and another winner will be selected through a random drawing at a date and time selected by Hospice.
Participants release Hospice, its directors, officers, employees, and agents from any and all liability for injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and the winner agrees to indemnify and hold Hospice harmless from any and all losses, damages, expenses (including attorneys’ fees and expenses),rights, claims, and actions of any kind arising in connection with or as a result of a winner’s acceptance or use of any prize.
Participants agree that their names and/or likeness may be disclosed and used by the news media and may otherwise be used by Hospice and On Top of the World Communities for publicity purposes. Participants agree that they may be contacted by Hospice and On Top of the World Communities; however, Participants may opt-out of such communications.
Disclaimer of all Other Representations and Warranties
There are no other representations or warranties other than set forth in these Official Rules and Conditions. Hospice disclaims all other representations and warranties express or implied, regarding the Homefree Prize Raffle. A participant’s sole and exclusive remedy against Hospice shall be limited to the lesser of the purchase price paid for his or her entry or $100.00. In no event shall Hospice be liable for any loss, damage or injury, including any lost earnings, profits, or goodwill, or any incidental, special, punitive, or consequential damages of and kind, whether arising in contract, tort, or otherwise, even if Hospice has been advised of the possibility of such damages.
